After earlier attempts were struck down, this case was brought by EMI, Sony, Warner Music and Universal music under new copyright laws brought in last year.

This Mechanical, 3D-Printed Entabulator Is An Amazing Tribute To The Power Of Clockwork

As a lover of all things mechanical I’m awe of Chris Fenton’s Entabulator. Using an old book on mechanical loom-making, a 3D printer, and some serious patience he engineered a computer that can read a program off of punch cards and, in this case, calculate the Fibonacci sequence. The machine runs using a hand crank (Fenton notes you can overclock it by cranking faster) and it is quite finicky but also quite beautiful in its own way. Obviously the world doesn’t need this entabulator. It is so wildly impractical that it’s almost ludicrous and the usability is limited (at least in this iteration)

Europe To Formalize How Consumers, Companies Can Sue Big Fish Like Google Over Antitrust Damages

Feeling slighted by Google’s dominance in search? In Europe, you may soon be able to sue for damages. A new proposal published today by the European Commission proposes to spell out the details, and effectively make it easier and quicker, for consumers and businesses to sue large companies when they feel that they have been the victims of antitrust violations. These would sit on top of European fines and sanctions on companies for the same violations. The proposals have been in the works for some time.

The social sound platform Audioboo will now play back audio files stored on its service directly within Twitter, thanks to its new Twitter Cards integration.

The Brighton-based audio company made the announcement on Friday, adding that it follows a period of rapid expansion in which it has opened a new office in San Francisco, revamped its website and delivered new versions of its apps for Android and iPhone.

“Twitter and Audioboo have always been a great combination, this latest development just makes that integration smoother and faster. Just like TwitPic brought images into Twitter’s timeline, now Audioboo is adding sound – without breaking away from the Twitter experience to visit another site,” Rob Proctor, CEO of Audioboo, said.

Twitter Cards allow developers to embed multimedia directly within tweets, meaning that users don’t have to navigate away from the main Twitter homepage to, for example, view an image or video, or in this case, listen to an audio file via a bespoke embed in the page.

While Audioboo users will likely welcome the new integration, it comes nearly a year after rival audio service SoundCloud introduced its Twitter Card integration.

Elon Musk has taken to Twitter to brush off suggestions of an upcoming IPO for SpaceX, claiming that the firm will not list until “the very long term” when it is busing people to Mars “regularly”.

Usually, a statement from a CEO that compares a public offering to colonising Mars would be as clear as denial as is possible. But, in the case of Musk, his business — or, at least, this particular business of his — is space exploration; so you can take that as a sign that there’ll be no IPO for a while, or that we’ll be colonizing Mars in the not too distant future.

Earlier this week, CNN suggested that now is the time for Musk to “capitalize on this moment and take yet another one of his ventures public”. The publication suggested that the buzz around SpaceX, coupled with the success of listed companies SolarCity (where Musk is chairman and shares have tripled in value in 2013) and Tesla, give it a platform for success on Wall Street.

Musk’s candour comes amid prior speculation about a SpaceX IPO. Last year, he told Business Week that the firm could list in 2013 — a fact that sources close to the company backed up — but his latest statement supersedes past rumors or expectations, and suggests the company is strictly focused on business for now.

SpaceX claims to have been cash positive for six years. The company has customer contracts worth an estimated $4 billion which extend into 2017, including satellite launches and delivering cargo to the International Space Station (ISS).

Musk has previously spoken about colonizing Mars in very bullish terms, explaining his belief that moving a family to the red planet should cost $500,000 by 2029.

SpaceX’s Dragon Capsule made its third trip to the ISS in March, while the firm is developing new technologies, including a re-usable rocket that has already passed a series of launch tests.

Judge limits texts, photos in Trayvon Martin case

(AP) — Attorneys won’t be able to mention Trayvon Martin’s drug use, suspension from school and past fighting during opening statements at the trial of a former neighborhood watch volunteer who fatally shot the teen, a judge ruled Tuesday.

However, Circuit Judge Debra Nelson left open the possibility that the defense could try again later during the trial if it could show relevance.

George Zimmerman is charged with second-degree murder in the 17-year-old’s killing and has pleaded not guilty, saying he acted in self-defense. He did not attend Tuesday’s hearing.

In another key motion Nelson refused to allow jurors to travel to the shooting scene during trial, and rejected a defense request to delay the trial set to begin June 10.

The judge called the request to let jurors see the crime scene “a logistical nightmare.”

Zimmerman’s attorney, Mark O’Mara, said Nelson’s decisions would not affect how he presented his case.

“We were hoping that we would have some limitations on people commenting upon information that is not yet relevant,” O’Mara said. “So the idea that the state will have to be careful about how they present their case — and certainly we’re going be careful about how we present ours — is exactly what we were hoping for.”

He acknowledged, however, that with the judge not delaying the trial the defense would “have a lot more work to do than we can get accomplished between now and June 10.”

The judge also ruled that some of the Martin’s texts and other social media statements won’t be allowed in opening statements, though it, too, could be allowed later with a ruling from the judge depending on how the case progresses.

O’Mara told the judge that Martin’s marijuana use and past fighting was central to the argument that Zimmerman used self-defense when he confronted Martin last year at a gated community in Sanford, Fla.

“We have a lot of evidence that marijuana use had something to do with the event,” O’Mara said. “It could have affected his behavior.”

An attorney for Martin’s family, Benjamin Crump, said the teen’s parents were pleased with the judge’s rulings on information they consider immaterial to the February 2012 shooting.

“Trayvon Martin is not on trial,” Crump said.

The judge ruled against a defense request that the pool of 500 jury candidates be sequestered during jury selection. She said jurors will be referred to by their jury numbers and prohibited their faces from being photographed. Nelson denied a prosecution request for a gag order that would prohibit attorneys from talking about the case.

O’Mara said he is concerned potential jurors could be affected by publicity the case is receiving.

The defense attorney had asked to push back the trial date because he said prosecutors had delayed turning over evidence as required. O’Mara is seeking sanctions against prosecutors, but a hearing on those sanctions was delayed until next week.

Before the judge decided to postpone the hearing on sanctions, a former prosecutor who used to work in the same office as the attorneys prosecuting Zimmerman testified he had told O’Mara about photos and text messages from Martin’s cell phone that hadn’t yet been turned over to the defense.

Former Assistant State Attorney Wesley White resigned last year from the State Attorney’s Office that covers northeast Florida.

Leonding (euro adhoc) - Rosenbauer and two other manufacturers have signed a
settlement agreement with the German municipal umbrella organizations providing
for out-of-court restitution in connection with the fire fighting vehicle cartel
in Germany.

Rosenbauer has always taken an active role in helping to determine what, if any,
harm may have been caused by the fire fighting vehicle cartel. Under this
out-of-court agreement, all affected local authorities that procured certain
types of municipal vehicle between 2000 and the middle of 2004 are to receive
compensation, regardless of which of the four manufacturers (Rosenbauer
Feuerwehrtechnik Luckenwalde, Iveco Magirus, Schlingmann or Ziegler) they
procured the said vehicles from. To this end, a settlement fund totalling up to
6.738 Mio EUR is being set up.

Rosenbauer Deutschland GmbH will be allocating up to 2.016 Mio EUR in
restitution to this settlement fund, thereby making a substantial contribution
towards implementing the compensation settlement between the individual
municipalities and the companies concerned. In so doing, Rosenbauer Deutschland
GmbH will also be taking on a significant share of the compensation that would
have been due from the insolvent manufacturer Ziegler, which is not a party to
the settlement.

The municipal umbrella organizations recommend municipalities to accept the
settlement agreement and to sign up to the pertinent inter-municipality
agreement that details how the compensation settlement is to be implemented
between the individual municipalities and the companies concerned.

To ensure correct and proper handling of the contract award process, Rosenbauer
has established a Group-wide compliance program. In addition, Rosenbauer has won
the required certification from an independent institution, in this case ZertBau
GmbH, which verifies companies' fitness and reliability in the procurement
field. This is accomplished by annual inspections focusing on the requirements
to be fulfilled regarding personnel and/or organizational structures, and on
compliant conduct on the part of the company, leading to certification as
appropriate.

(AP) — Jurors reached a verdict Wednesday in the trial of Jodi Arias, who is accused of murdering her one-time boyfriend in Arizona.

Arias is charged with first-degree murder in the June 2008 death of Travis Alexander, a motivational speaker and salesman, at his suburban Phoenix home. Authorities said she planned the attack in a jealous rage after being rejected by the victim while he pursued other women.

Arias initially denied involvement and later blamed the killing on masked intruders. Two years after her arrest, she said she killed Alexander in self-defense.

Jurors got the case Friday. They reached a decision late Wednesday morning, but it has not yet been announced.

Testimony in the trial began in early January, with Arias later spending 18 days on the witness stand. The trial quickly snowballed into a made-for-the-tabloids drama, garnering daily coverage from cable news networks, and spawning a virtual cottage industry for talk shows, legal experts and even Arias, who used her notoriety to sell artwork she made in jail.

Alexander suffered nearly 30 knife wounds, was shot in the forehead and had his throat slit before Arias dragged his body into his shower. He was found by friends about five days later.

Arias said she recalled Alexander attacking her in a fury after a day of sex. She said Alexander came at her “like a linebacker,” body-slamming her to the tile floor. She managed to wriggle free and ran into his closet to retrieve a gun he kept on a shelf. She said she fired in self-defense but had no memory of stabbing him.

Arias acknowledged trying to clean the scene of the killing, dumping the gun in the desert and working on an alibi to avoid suspicion. She said she was too scared and ashamed to tell the truth.

A ‘site issue’ is preventing some users from logging into Facebook

Yesterday, Twitter experienced issues loading new tweets for nearly one hour and today it appears to be the turn of Facebook, as a number of users are currently unable to log into the social networking site due to an error

TNW staff in North America and Asia are not having issues accessing Facebook, but other users are less fortunate. According to Web monitoring service Downrightnow.com, Facebook has experienced a ‘Likely Service Disruption’ since 18:00 PDT, 02:00 BST — that’s more an hour ago at time of writing.

Users that are affected are being greeting with the below message — via @niw — that explains that a “site issue” has made their account temporarily unavailable. The message provides no further details.

It is not clear if the issue is restricted to certain regions or is affecting users worldwide, plenty have taken to Twitter (see search) to vent their frustration:

As we said yesterday in the case of Twitter, downtime is never welcome for any Internet site, particularly those that are used on a daily basis by millions. Facebook will be looking to fix whatever the problem is quickly.

This is the case for Instagram, and the Facebook-owned photo sharing service has released a new logo today, built heavily atop its previous script logotype.
